Acceptance of Terms

By accessing or using https://ai8ght.ai, https://app.ai8ght.com, running a Free Online Business Audit, submitting an inquiry form, or completing a subscription checkout with AI8GHT ("Company," "we," "us," or "our"), you ("Client," "User," or "you") agree to be bound by these Terms & Conditions and our Privacy Policy.

If you are entering into this Agreement on behalf of a company, brokerage, clinic, dealership, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

Scope of Services

AI8GHT provides modular, subscription-based digital growth infrastructure and software-enabled services, including:

• Website Development & Maintenance: High-speed multi-page websites, custom web applications, client portals, dedicated VPS hosting, SSL provisioning, and ongoing technical maintenance.
• Short-Form Video (Reels, Shorts & UGC) & Social Media Management: Scripted vertical video production, kinetic captioning, AI UGC avatar synthesis, static social graphics, and scheduled multi-channel distribution.
• Triple-Engine Search (SEO, AEO & GEO): Technical search engine optimization, Answer Engine Optimization for AI assistants, and Generative Engine Optimization for local and commercial authority.
• Paid Ads & Autonomous AI Voice/SMS Integration: Paid media campaign management, 24/7 AI Voice receptionist agents, instant speed-to-lead SMS follow-up workflows, and CRM pipeline synchronization.
• Free Online Business Forensic Audit: Automated diagnostic scanning of public business profiles, website speed, search visibility, and lead response infrastructure.

Client Intake Gate & Revision Policy

To ensure rapid delivery and consistent quality across all client deployments, you agree to the following operational rules:

• Mandatory Intake Hard Gate: Production timelines (including 48–72 hour initial turnarounds) begin only after you have submitted all required onboarding materials through the Client Portal (/portal or app.ai8ght.com), including vector logos, brand hex codes, domain DNS credentials, and social account access.
• 5-Minor-Revision Inclusion: Each website build or monthly content batch includes up to five (5) minor revisions (such as headline/copy adjustments, image swaps, color tint tweaks, or routing updates).
• Out-of-Scope Requests: Complete structural layout overhauls after approval, mid-project niche pivots, or unquoted custom backend integrations are not minor revisions. Additional blocks of 3 minor revisions may be purchased for $50, or custom development scopes will be quoted separately prior to execution.

Subscriptions, Billing & Cancellation

• Introductory & Standard Monthly Rates: Where applicable, promotional 90-day introductory pricing applies for the first three (3) monthly billing cycles, after which the subscription automatically transitions to the disclosed Day-91 standard monthly rate unless modified or canceled prior to renewal.
• Recurring Billing Authorization: By providing a payment method through our Stripe-powered checkout, you authorize AI8GHT to charge your designated payment method on a recurring monthly basis for your selected growth stack and any approved add-ons.
• Ad Spend Separation: Monthly management fees for Paid Ads do not include third-party media spend paid directly to Meta, Google, TikTok, or other ad networks.
• Cancellation Policy: You may cancel your monthly subscription at any time by providing written notice via your Client Portal or by emailing support@ai8ght.ai at least five (5) business days before your next billing date. Because creative, engineering, and server resources are allocated immediately upon billing, fees for the current billing cycle are non-refundable once the cycle has commenced.

Intellectual Property & Client Assets

• Client-Provided Content: You retain full ownership of all trademarks, logos, raw video footage, photography, and proprietary business data you supply to AI8GHT. You grant AI8GHT a non-exclusive license to use, host, edit, and distribute these assets solely to perform the contracted services.
• Deliverables & Managed Infrastructure: Custom brand copy and exported social media videos paid for in full may be used by you across your channels. Proprietary AI8GHT software engines, automation workflows, custom code frameworks, and managed VPS environments remain the intellectual property of AI8GHT during an active subscription unless a dedicated buyout or self-hosted transfer is executed.

Acceptable Use & Regulatory Compliance

You agree not to use AI8GHT websites, AI builders, or telephony agents for any unlawful, deceptive, defamatory, or fraudulent purpose, or to transmit unsolicited bulk spam in violation of the TCPA, CAN-SPAM Act, CASL, or carrier A2P 10DLC policies. We reserve the right to suspend or terminate any workspace that violates telecommunications regulations or endangers network deliverability.

Disclaimers & Performance Benchmarks

While AI8GHT engineers high-converting websites, viral-modeled short-form video, and sub-15-second speed-to-lead AI systems, commercial outcomes depend on numerous market factors outside our control (including your industry, pricing, local competition, ad budget, and sales closing processes). Case study metrics displayed on our website represent audited historical results for specific clients and do not constitute a guarantee of identical revenue or lead volume. All services and diagnostic audit tools are provided on an "as-is" and "as-available" basis.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall AI8GHT, its officers, directors, employees, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business interruption. AI8GHT's total cumulative liability arising out of or relating to this Agreement shall not exceed the total subscription fees actually paid by you to AI8GHT during the three (3) months immediately preceding the event giving rise to the claim.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable federal and provincial/state laws of North America, without regard to conflict of law principles. Any dispute arising from these Terms or our services shall first be addressed through good-faith informal negotiation by contacting support@ai8ght.ai for at least thirty (30) days before initiating formal proceedings.
